36. Ending the Tenancy, Notice and Possession
36.1 You may end the Tenancy by giving notice in accordance with Clause 10. You remain liable for rent and other obligations until the Tenancy lawfully ends.
36.2 We may recover possession only by lawful means and in accordance with the Housing Act 1988 and other applicable law. Where possession is sought, we will serve the appropriate prescribed notice specifying the applicable ground or grounds and required notice period and, where necessary, apply to the court for a possession order.
36.3 For the purposes of Ground 4A of Schedule 2 to the Housing Act 1988 (as amended), you are notified that possession may be sought because the Property is let to full-time students and is intended to be occupied by full-time students in the subsequent academic year. Any possession proceedings relying on Ground 4A will be subject to the statutory requirements applicable to that ground.
36.4 If the parties agree to bring the tenancy to an end by mutual agreement, this may be done by a separate written agreement between us and all parties to the Tenancy. Any new tenancy subsequently granted will be a separate tenancy and will be subject to its own terms.
36.5 If you indicate that you intend to leave before the tenacy ends, you remain liable for rent and other obligations until the Tenancy lawfully ends, unless we agree otherwise in writing. We will take reasonable steps to re-let the Property where appropriate and you must
reasonably cooperate with this, including allowing access for viewings.
36.6 If the Property is destroyed or rendered unfit fit for occupation by fire, flood or other unavoidable event, the Tenancy may end in accordance with applicable law. We are not required to provide alternative accommodation unless required by law.
36.7 Ending the tenancy does not release you from obligations accrued before the Tenancy ended, including rent arrears, damage or other liabilities. At the end of the Tenancy, you must give vacant possession, return all keys and comply with the end-of-tenancy requirements in Clause 34.
36.8 Nothing in this Clause affects your rights under the Protection from Eviction Act 1977.
