15 Equality Act 2010, Section 190
Where a disabled person occupies or intends to occupy the Property as their only or main home, they may request in writing our consent to make reasonable adaptations or improvements likely to facilitate their use and enjoyment of the Property having regard to their disability. Where Section 190 of the Equality Act 2010 applies, we will not unreasonably withhold such consent.
15.1 Any request must include reasonable details of the proposed works and any consent may be subject to reasonable conditions, including compliance with legal and safety requirements, the manner of carrying out works, responsibility for costs, maintenance and (where reasonable) reinstatement at the end of the Tenancy.
15.2 Nothing in this agreement requires us to carry out or pay for any adaptations unless legally obliged to do so and to the extent that this agreement makes provision of a like nature, the rights and obligations under Section 190 shall not apply.
16. Vacant Possession
16.1 This Tenancy is granted to you jointly and severally and is conditional upon vacant possession of the Property being available on the Commencement Date.
16.2 If the Property is not ready for you to move into on the Commencement Date, the Tenancy will start when it becomes available. Any rent you have already paid will be applied to the Tenancy from that new start date and you will not be charged for any earlier period. If the Tenancy does not go ahead, any rent paid in advance will be refunded in full.
16.3 We and you (acting jointly) may agree in writing a revised commencement date, with rent apportioned accordingly.
16.4 If vacant possession is not available within a reasonable time and no revised Commencement Date is agreed, we or you (acting jointly) may withdraw by written notice. The Tenancy must not proceed and sums paid must be refunded in accordance with law.
16.5 You acknowledge this is a joint tenancy and no individual Tenant may require it to proceed independently.
16.6 We shall not be liable for any indirect or consequential loss arising from any delay in providing vacant possession, except where caused by negligence, breach of statutory duty or non-excluded liability.
