9. Mandatory Statutory Prior Notice: Ground 4A for Student Accommodation
9.1. In accordance with Paragraph 10 of Schedule 1 to the Renters' Rights Act 2025, amending Schedule 2 to the Housing Act 1988, we hereby give you and you acknowledge receipt of, prior written notice before this Tenancy Agreement is entered into that we may require and seek possession of the Property under Ground 4A of Schedule 2 to the Housing Act 1988.
9.2 You are explicitly notified that we are entitled to recover possession of the Property on the basis that:
9.21 The Property is a House in Multiple Occupation (HMO);
9.22 You are (or we have reasonable grounds to believe you will be) full-time students on a recognised course of study at the time this tenancy is entered into; and
9.23 We intend, on the next occasion on which the Property is let, to re-let to full-time students on a recognised course of study.
9.24 Clauses 9.21, 9.22 and 9.23 are a fundamental condition of the Tenancy.
9.3 You acknowledge and agree to the following statutory terms of operation for Ground 4A:
9.31 We have a mandatory right to recover possession to align with the standard university academic cycle.
9.32 If we seek possession under this Ground, we must serve you with a valid Section 8 Notice providing a minimum notice period of four (4) months.
9.33 Any notice to quit served by us relying on Ground 4A must be scheduled to expire on a date falling within the period beginning with 1 June and ending with 30 September in any given calendar year.
9.4. By signing this Tenancy Agreement, you confirm you are full-time students (or will be at the start of the tenancy), fully understand that this Property is designated for student accommodation and explicitly acknowledge receipt of this Ground 4A Prior Notice before becoming legally bound by this contract.
