“Commencement Date” means the date on which the Tenancy is to start as stated in this Agreement or such later date as the Tenancy actually begins where commencement is delayed in accordance with this Agreement (including where vacant possession is not available).

“Deadline for Agreement” means the statutory period under the Tenant Fees Act 2019 within which a tenancy must be entered into following payment of a holding deposit, unless extended in accordance with this Agreement.

“Deed of Guarantee” means a separate legally binding agreement between a Guarantor and us under which the Guarantor guarantees your obligations under this Agreement.

“Emergency” means any situation which, if not dealt with promptly, may pose a risk to the Property, Contents or health and safety of any person, including activation of an intruder alarm or the Property being insecure when unoccupied.

“E-Vehicle Safety Agreement” means a separate written agreement setting out the terms and conditions for storing, charging or using any e-bike, e-scooter or similar battery-powered device at the Property, including requirements relating to safety, storage and charging. 

“Fair Wear and Tear” means reasonable deterioration resulting from normal residential use, having regard to age, quality, condition at the start of the Tenancy and length of occupation. It relates to condition, not cleanliness. It does not include damage, staining, mould, odour, neglect, misuse or failure to clean or maintain the Property. Assessment will consider all relevant circumstances.

"Fixtures and Fittings" means items attached to or forming part of the Property, including furniture, fixtures, fittings and floor, ceiling or wall coverings.

“Guarantor” means a person who has entered into a Deed of Guarantee and agrees to guarantee the obligations of a Tenant under this Agreement. 

“Holding Deposit” means a payment made to reserve the Property before the Tenancy starts, governed by the Tenant Fees Act 2019 and a separate holding deposit agreement.
